How it works

The Path to a Registered Mark

  1. Clearance Search

We check federal, state and common-law records before you file or launch.

  2. Application Filed

Your application goes to the USPTO with the right classes, basis and specimen.

  3. Examination

An examining attorney reviews it. We answer any office action on your behalf.

  4. Publication

The mark appears in the Official Gazette, opening a 30-day opposition period.

  5. Registration & Upkeep

You can use the ® symbol. We track your Section 8 and 9 maintenance deadlines.

Trademark FAQ

Common Questions

Short answers to what business owners ask us most. Every brand is different, so call us for advice on yours.

What is the difference between ™ and ®?

Anyone can use ™ to claim rights in a mark. The ® symbol may only be used once the mark is registered with the USPTO, and only for the goods and services listed in the registration.

Do I need to register to have trademark rights?

Using a mark in commerce creates common-law rights, but they are usually limited to the area where you do business. Federal registration gives you nationwide priority, a public record of ownership, and stronger tools for enforcement.

How long does federal registration take?

Timelines vary with USPTO workload and whether the application draws an office action or an opposition. Many applications take a year or longer from filing to registration.

I received a USPTO office action. What now?

Note the response deadline, which is generally three months from the issue date and can be extended once for a fee. Missing it can lead to abandonment of the application, so contact an attorney early.
